Terms and Conditions for Max Renovators

These Terms and Conditions ("Agreement") govern the relationship between

Max Renovators

("Max Renovators," "we," "our," or "us"), a company specializing in home additions and high-end renovations, and the client ("you" or "the client") seeking to engage in a construction, renovation, or home addition project with us. By entering into a business relationship with Max Renovators, you agree to the terms and conditions outlined in this Agreement.

2. Services Provided


Max Renovators specializes in high-end home renovations and custom home additions, which include but are not limited to:

Home Additions: Expanding your living space through new rooms, second stories, or additional structures. Kitchen and Bathroom Renovations: High-end updates with custom finishes.Whole-House Renovations: Comprehensive renovations, including structural, aesthetic, and mechanical updates. Design and Build Services: Complete design-build solutions, from initial concept to final construction.Exterior and Interior Remodeling: Enhancing both the exterior and interior of the home with custom materials and expert craftsmanship.

The specific services to be provided will be outlined in the project agreement or proposal.

3. Service Agreement and Project Scope

Each project is governed by a separate

Service Agreement

that will outline the following:

Scope of Work: A detailed description of the work to be performed, including the design, materials, and any customizations agreed upon.Timeline: Estimated start and completion dates for the project. The timeline is an estimate and may be adjusted based on various factors, such as weather or permit delays.Pricing: The agreed-upon cost for the project, including the payment schedule and any applicable taxes.Project Milestones: Specific milestones and payments due upon completion of each stage of the project.

Both parties must review, agree to, and sign the Service Agreement before work commences.

4. Payment Terms

Deposit: A deposit of the total project cost is required upon signing the Service Agreement to secure the project. This deposit will be applied toward the total project cost.Progress Payments: Subsequent payments will be due upon the completion of specific milestones during the project, as outlined in the Service Agreement. These payments must be made within of receipt of the invoice final. Payment: The remaining balance is due upon completion of the project, before the final inspection, handover, or client sign-off.Late Payments: If payments are not made within the specified period, Max Renovators reserves the right to charge a late fee and any ongoing work may be paused until payment is received. Accepted Payment Methods: Max Renovators accepts payments via [methods such as credit card, bank transfer, check, etc.]. Payment details will be provided in the Service Agreement.

Please note that all payments made to Max Renovators are non-refundable unless otherwise agreed in writing.

5. Client Responsibilities

Access to Property: The client is responsible for providing full access to the property during regular business hours to allow Max Renovators and its subcontractors to complete the work. Property Conditions: The client must inform Max Renovators of any pre-existing conditions or issues at the property that could impact the scope or cost of the project.Approvals and Permits: The client will be responsible for obtaining any necessary permits or approvals unless otherwise specified in the Service Agreement.

Design Approval: The client must approve any designs, plans, or drawings before construction begins. Changes to the design after work has commenced may result in additional costs and delays.

6. Changes and Modifications

Change Orders: Any changes to the original scope of work requested by the client after the Service Agreement has been signed will require a formal change order. The change order will outline the revised scope, cost, and any adjustments to the project timeline.Client Requests: If the client requests design modifications, additional work, or changes to materials, Max Renovators will provide an updated proposal, which must be signed by both parties before proceeding with any adjustments to the project.

7. Timeline and Delays

Estimated Timeline: The timeline for each project is an estimate based on the scope of work and is subject to change due to factors such as weather conditions, material availability, and unforeseen issues that may arise during construction.Client-Related Delays: Any delays caused by the client, such as failure to approve design changes, delays in payments, or failure to provide necessary information, may result in an extended project timeline. Force Majeure: Max Renovators will not be held responsible for delays caused by circumstances beyond our control, including but not limited to acts of God, natural disasters, strikes, pandemics, or government restrictions.


8. Warranty

Max Renovators provides a limited warranty for the work performed. The warranty details are as follows:

Labor Warranty: A warranty on the workmanship provided by Max Renovators will cover defects in labor for a period from the completion date of the project.Material Warranty: Manufacturer warranties on materials or products installed will apply, and the client should directly contact the manufacturer for any warranty claims.Exclusions: The warranty does not cover damage caused by misuse, neglect, or accidents after the work is completed, nor does it cover issues arising from external factors beyond our control (e.g., natural disasters, structural damage unrelated to our work).

9. Liability and Indemnity

Limitation of Liability: Max Renovators will not be liable for any indirect, incidental, special, or consequential damages arising from the completion of the project, including property damage, personal injury, or loss of business. Our liability will be limited to the total amount paid by the client for the specific project or service.Indemnification: The client agrees to indemnify and hold harmless Max Renovators, its employees, subcontractors, and agents against any claims, losses, damages, or liabilities arising out of the client’s use of the property, including any third-party claims.


10. Insurance

Max Renovators maintains general liability insurance and workers' compensation insurance for the duration of the project. The client is encouraged to verify their own insurance coverage to protect against risks during the renovation process.

11. Termination

By the Client: The client may terminate the Service Agreement by providing written notice to Max Renovators. In the event of termination, the client will be responsible for all work completed up to the termination date and any additional costs incurred due to early termination. By Max Renovators: Max Renovators may terminate the agreement if the client fails to make timely payments, provides inaccurate information, or causes significant delays that impede progress. In such cases, the client will be liable for all work completed up to the point of termination.


12. Dispute Resolution

In the event of a dispute, both parties agree to first attempt to resolve the issue through informal discussions. If a resolution cannot be reached, the dispute will be submitted to binding arbitration in accordance with the rules of the American Arbitration Association. The venue for arbitration will be located in Chester, NJ.

13. Governing Law

This Agreement will be governed by and construed in accordance with the laws of the State of New Jersey. Any disputes or legal actions arising from this Agreement will be subject to the exclusive jurisdiction of the courts of New Jersey.

14. Amendments

Max Renovators reserves the right to update or modify these Terms and Conditions at any time. Any changes to these Terms and Conditions will be communicated to the client and will become effective upon publication of the revised document.
